Texas Tailgating Accident Lawyer

Tailgating drivers on Texas roadways put innocent drivers and passengers at risk of serious injury or death. One example of negligent driving is tailgating, which occurs when a driver follows another vehicle too closely. If the car in front suddenly needs to stop, the tailgater could collide with the other vehicle, potentially causing severe injuries.

Fielding Law has seen many motor vehicle accidents caused by tailgating leave victims with substantial medical debt, lost income, and pain and suffering. We believe that aggressive and negligent drivers should be held responsible for their actions. How?

Texas Tailgating Law

According to the following distance Texas transportation code 545.062, “An operator, shall, if following another vehicle, maintain an assured clear distance between the two vehicles so that, considering the speed of the vehicles, traffic, and conditions of the highway, the operator can safely stop without colliding with the preceding vehicle or veering into another vehicle, object, or person on or near the highway.”

In other words, tailgating is a traffic offense taken seriously in Texas. In fact, a law enforcement officer can pull you over and give you a ticket for following too closely.

How do you know the safe distance between cars? The Texas driver’s handbook recommends that you maintain a following distance of 2 seconds when driving at a speed of 30 mph or less in good road conditions. The following distance should be increased to 4 seconds when driving at a higher speed. When driving in poor road or weather conditions, a driver may need to allow for an even greater space cushion between vehicles.

How a Tailgating Car Accident Attorney Can Help After a Rear-end Collision

An essential step in making any motor vehicle accident claim is establishing who was at fault. Motor vehicle collisions may involve multiple at-fault parties that share varying degrees of negligence. In Texas, if you are found partially liable for an auto accident, your damages may be reduced.

On top of that, if the insurance company of the tailgating driver suspects they are going to have to pay out a lot of money in compensatory damages, they may take measures to minimize their losses. The company might pressure you into accepting a settlement offer that is far less than what your claim is truly worth. They may even have their own legal defense team come up against you.

Texas Tailgating Accidents Involving Semis and Other Large Trucks

Some of the most severe rear-end collisions involved semis, 18-wheelers, and other large trucks. While a standard-size vehicle typically weighs between 2,000 and 5,000 pounds, a fully loaded semi will usually weigh up to 80,000 pounds in Utah. Considering the size and weight of these massive vehicles, it’s easy to see why a collision involving them could be catastrophic.

Commercial truck drivers usually have a limited amount of time to deliver the load they’re hauling, and the faster they work, the more money they make. Unfortunately, this makes truck drivers likely to speed, tailgate, and drive recklessly in other ways.

If your rear-end collision and injuries were caused by a negligent truck driver, the lawyers at Fielding Law are here to help. We can identify all liable parties involved and fight to hold each accountable for their actions. Schedule a free case consultation with us today to get started.
